Terms of Use

1.1 What Gallopr Is

Gallopr is a free-to-play prediction game in which players select horses in real-world horse races and earn points based on how those selections finish. Players compete on leaderboards for entertainment and bragging rights only.

1.2 What Gallopr Is Not

Gallopr is not a gambling, betting, or wagering service. No real money is staked, wagered, won, or lost through the Game. We do not hold a gambling licence in any jurisdiction and do not facilitate any form of gambling.

Starting Prices (SP), odds, and odds-tier labels displayed within the Game are used solely for the purpose of calculating points within the Game's scoring system. They do not represent an offer or invitation to place a bet, nor do they constitute financial or gambling advice. No betting functionality exists within the Service.

1.3 Prizes and Rewards

At present, Gallopr does not offer any prizes, monetary rewards, or incentives. The Game is played purely for entertainment and competition among players. We reserve the right to introduce prizes, rewards, promotional offers, sponsorships, or premium features in the future, subject to additional terms and all applicable regulations.

2.1 Age Requirement

You must be at least 13 years of age to create an account and use the Service. By creating an account, you confirm that you are 13 years of age or older. If we learn that a user is under 13, we will terminate their account and delete their personal data.

If you are between 13 and 18 years of age (or the age of majority in your jurisdiction), you confirm that you have obtained consent from a parent or legal guardian to use the Service and that they have read and agree to these Terms on your behalf.

2.2 Restricted Jurisdictions

The Service is intended for use in jurisdictions where free-to-play prediction games are lawful. You are responsible for ensuring that your use of Gallopr complies with the laws of your country or region. We reserve the right to restrict or terminate access from any jurisdiction at our sole discretion.

2.3 Account Registration

To use the Game, you must create an account using a valid email address and password. You agree to provide accurate information during registration and to keep your login credentials secure. You are responsible for all activity that occurs under your account. Notify us immediately at jake@valyra.ai if you become aware of any unauthorised use of your account.

3.1 Game Mechanics

The rules, scoring system, power-ups, leaderboard structures, and other game mechanics are described within the Game and may be updated at our discretion. We reserve the right to modify any aspect of the scoring system, points structure, or game features at any time.

3.2 Fair Play

You agree to use the Service fairly. You must not:

• Create multiple accounts to gain an unfair advantage
• Use automated tools, bots, or scripts to interact with the Service
• Attempt to manipulate leaderboards, points, or game outcomes
• Exploit bugs or unintended features (report them to us instead)
• Collude with other players to manipulate league standings or matchup outcomes

3.3 User Conduct

When using the Service, you must not:

• Use offensive, discriminatory, or abusive language or display names
• Impersonate another person or entity
• Harass, bully, or intimidate other users
• Use the Service for commercial purposes without our written consent
• Attempt to tamper with or disrupt any part of the Service
• Reverse-engineer or decompile any part of the Service

3.4 Enforcement

We may investigate suspected violations and take action including warnings, points resets, account suspension, or permanent termination. We are not obligated to provide advance notice before taking enforcement action.

4.1 Our Intellectual Property

All content, design, branding, logos, graphics, text, software, and other materials comprising the Service are owned by or licensed to Valyra FZ-LLC. You may not copy, reproduce, or distribute any Gallopr content without our prior written consent.

4.2 Third-Party Content

The Service may display horse racing data including horse names, jockey and trainer names, form data, and silks images sourced from third-party providers. You may not extract, scrape, or reproduce this data.

4.3 User Content

By creating a display name or otherwise generating content within the Service, you grant us a non-exclusive, worldwide, royalty-free licence to use that content in connection with operating and promoting the Service. Game data such as your picks, points, and statistics may be used in aggregated or anonymised form.

5.1 Service Availability

The Service is provided on an “as available” basis. We do not guarantee uninterrupted or error-free access. The Game depends on real-world racing events and third-party infrastructure outside our control.

5.2 Modifications

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time. We will make reasonable efforts to communicate significant changes.

5.3 Account Termination by You

You may close your account at any time by contacting us at jake@valyra.ai. Your personal data will be handled in accordance with our Privacy Policy.

5.4 Account Termination by Us

We may suspend or terminate your account at any time, including for breach of these Terms, suspected fraud or abuse, or discontinuation of the Service. We are not liable for any loss arising from account termination.

6.1 No Warranties

The Service is provided “as is” and “as available” without warranties of any kind. We do not warrant that the Service will be uninterrupted, secure, or free of errors.

6.2 Racing Data and Odds

All racing data, odds, and starting prices are provided for informational and game-scoring purposes only. They must not be relied upon for any gambling, financial, or betting decisions. We accept no liability for decisions made based on data displayed within the Service.

6.3 Limitation of Liability

To the fullest extent permitted by applicable law, Valyra FZ-LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Service. Our total aggregate liability shall not exceed USD $100 or the amount you have paid us in the preceding 12 months, whichever is greater.

6.4 Indemnification

You agree to indemnify and hold harmless Valyra FZ-LLC and its officers, employees, and agents from any claims, liabilities, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

7.1 Service Communications

By creating an account, you consent to receiving service-related emails including account confirmations, password resets, festival announcements, game updates, and other communications essential to the operation of the Service. These cannot be opted out of while maintaining an active account.

7.2 Marketing Communications

During registration, you may choose to opt in to marketing emails including tips, insights, offers, and news. These are entirely optional and sent via Mailchimp. You may unsubscribe at any time via the link in any marketing email or by contacting jake@valyra.ai.

9.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Dubai International Financial Centre (DIFC), United Arab Emirates.

9.2 Jurisdiction

The courts of the DIFC shall have exclusive jurisdiction to settle any dispute arising out of these Terms. We retain the right to seek injunctive relief in any competent jurisdiction.

Before initiating formal proceedings, please contact us at jake@valyra.ai. We will endeavour to respond within 14 days and work in good faith to resolve any dispute.
